• Intellectual property
The software, graphic designs and logos, images and photographs, as well as any content published on www.ircc.photo, are protected by Spanish legislation and international legislation on intellectual and industrial property rights in favor of IRCC Photographic Association or its legal authors, and copying, reproduction and / or publication, in whole or in part, of any of the contents of the website, nor its computer processing, distribution, dissemination, modification or other legally recognized rights to its holder, without the prior written consent of the same, of its authors and / or IRCC.
IRCC has its name and trademark registered and cannot be used in connection with any product or service without the prior written consent of IRCC. The images and icons available from IRCC may only be used by third-party partners and sites in connection with the provision of appropriate links to the IRCC website provided they are used in a manner consistent with these terms. Likewise, IRCC images and icons may be used when they are inserted in photographs of registered users / photographers, as their watermark.
• Description of services
IRCC Photographic Association (IRCC) provides a platform through its website, as a meeting point for nature photography and photojournalism, aimed at a community of registered users, to participate in a variety of activities such as loading and viewing photographs, share content through portfolios and photo galleries, promote image collections, participate in contests and promotions, as well as the possibility of certifying the authenticity of the visual content of photographs by comparing them with the original files as source of each photograph .
• Advantages of using user accounts in IRCC
The user accounts on the IRCC website are free, providing their own space for the registered user / photographer where they can manage their visual content and benefit from authentication services through photography certification. The certification is supported by the Associations, Institutions, Collaborating Entities, Photographers and Promoters of International Photography Contests that are cited in the “Associates” section.
The user account is accessible virtually anywhere and at any time through the site www.ircc.photo.
The use of the registered accounts on the IRCC website and the subscription of temporary certification services provide the possibility of:
- Administration of your profile and access to technical support
- Subscription management and access to promotions linked to Associations and Collaborating Entities
- Management of your visual content and access to learning resources
- Free publication of your portfolio selectively
- Access to participation in photographic contests under the “certified user” modality, with discounts on the participation fee
- Download certified image files for access to photographic contests
- Download image files certified with QR code and / or watermark for publication on social networks
• Acceptance of terms
IRCC, at its sole discretion, or due to mandatory legal provisions, may modify or replace these terms at any time. If the modifications constitute a significant material change on the current terms or conditions, IRCC will notify them by dissemination in the "News" section, or by private notifications addressed to registered users.
The user is responsible for reviewing and familiarizing themselves with any modifications and the correct use of the services, being subject to the guidelines, terms or conditions published and applicable to said services.
Your access or use of our services may be temporarily interrupted as a result of any malfunction, update, maintenance or fall of the service on the website, or any other reason within or beyond our control.
IRCC reserves the right to suspend or discontinue the availability of the site, of any service and to eliminate any visual content at any time at its sole discretion and without prior notice, due to force majeure.
IRCC may impose limits on certain features and services or restrict your access to parts or all of the site and services without notice or liability.
• IRCC registration
As a condition for the use of services, you must open an account on this website, select a password and username, and provide the required registration information. The registration information you provide must be accurate, complete and up-to-date at all times, and should not contain offensive or obscene content in any case. Failure to respect these conditions could result in the immediate termination of your access to IRCC services.
The user is responsible for maintaining the confidentiality of his password and is solely responsible for all activities resulting from the use of his password and carried out through his account.
IRCC services are available to people over 18 years of age, or at least 14 years of age as long as they are authorized to access the site by a parent or legal guardian. In this case and by authorizing a minor to use the services of the IRCC website, the parent or legal guardian is responsible for the conduct of said minor and for the consequences of any misuse of the site by the minor.
• General conditions of use
The registered user is responsible for all its content and for ensuring that its content and its use comply with current laws or regulations and with these Terms and Conditions. Likewise, the registered user guarantees that its content will not infringe or misappropriate any intellectual property or property rights of any person or violate any applicable law or regulation.
- User behavior
Any image published in your account must have been photographed by the registered user of the registered account. All visual content published or sent to the site, as well as any comments or descriptions about it, are the sole responsibility of the owner of the user account, being responsible for everything published and expressly not using the services for any purpose that is illegal or prohibited by the published terms.
User is required for the acceptance of the "Ethical Manifesto" enabled in the application form for IRCC certificates, as an express statement by the photographer on compliance with the provisions contained therein.
Users / photographers must be the sole owners of the copyright of the photographs and shall be fully responsible for the absence of third-party rights in the works presented, as well as any claim for image rights.
IRCC will immediately respond to any third-party claim on content published on the site that could infringe the copyright or other intellectual property rights of any claimant that is recognized as the owner of these. IRCC will make all reasonable efforts to investigate notifications of alleged infringements and will take appropriate measures under applicable intellectual property legislation, where appropriate eliminating or deactivating access to content that is claimed to infringe and / or canceling the user accounts that have led to the alleged violation.
To make a claim to IRCC about a possible copyright infringement, you must send your written notification to email@example.com and include in your notification a detailed description of the alleged infringement, as well as a statement by you under penalty of perjury of that the information in your notice is accurate and that you are the owner of the copyright or are authorized to act on behalf of the owner of the copyright.
- Image rights
The photographs where a recognizable or identifiable person appears (categories with the possibility of inclusion of persons) must have their express consent and include the permission to transfer the image rights. IRCC will not be responsible for possible claims to the authors.
- About the use of content
In no way will IRCC use the information contained in user registration files, nor will it use with or without limitation any photographs published on the site for any commercial use.
IRCC software restricts the ability of users and visitors to the site to make low-resolution or 'miniature' copies of published visual content. However, IRCC does not guarantee that the visual content published on the site will not be illegally copied without your consent.
The Digital Millennium Copyright Act of 1998 (the "DMCA") offers resources for copyright owners who believe that material appearing on the Internet infringes their rights under the rights law Author of the United States. In the event that you consider that any visual content published on the IRCC website infringes your copyright, you may send IRCC a Notice requesting that IRCC delete the material or block its access. If you believe in good faith that someone has incorrectly submitted a Notice of Copyright Infringement against you, the DMCA allows you to send a counter notification to IRCC. • Temporary certification service subscriptions
IRCC provides registered users / photographers the possibility of obtaining “IRCC certificates” for their photographs.
Once the registration has been made, a limited number of credits are automatically assigned that the photographer can use to certify his photographs and may optionally request an annual subscription through which additional credits will be granted for the processing of new certifications. The credits associated with the subscription will be subject to the conditions in force at the time of registration, being able to benefit from extensions of credits for belonging to certain Photographic Associations with agreements signed with IRCC.
The application for each certification entails the consumption of credits established in the conditions in force on the date of application, except in the cases of a second request on the same photograph initially rejected (option for a new certification application).
The obtaining of IRCC certificates on photographs is subject to the processes of automatic diagnosis and visual analysis of the respective images, being granted in average terms of less than 2 hours from the moment of processing and acceptance of each new application. However, there may be specific delays in obtaining certifications, depending on the time of your request, depending on volume and demand, or by virtue of any anomaly detected in the files submitted which are part of the application.
Keep in mind that the complete processes of automatic and visual analysis and diagnosis that concludes in the granting of the IRCC certification, are quantified in approximately 15 minutes from the end of the application by the user. Although, depending on volume and demand, there will be resolutions on applications in longer terms.
In no case will the resolution of the IRCC certification application be resolved in terms longer than 12 hours from the moment of completion of the request by the user.
All incidents that may occur in relation to the application for certifications will be processed in the shortest possible time. There are “tickets” channel available for fluid communications with respect to the incidents occurred, being the preferred way for resolving incidents.
Once the credits assigned to the annual subscription have been consumed, the user / photographer may apply for new certifications by acquiring new credits (individual or bonds) in accordance with the conditions in force at the time of the application.
Both the annual subscription service, as well as the acquisition of credits for the application of new certifications, will be subject to the disbursement of the quotas stipulated and published at any time.
All the contributions received by the aforementioned concepts will be destined to cover the expenses derived from the management and technological services provided by IRCC.
The payment of the requested services will be carried out through any of the payment methods enabled on the website and accessible from the menus of the user accounts.
IRCC will not provide refunds for annual subscription payments, regardless of the expiration date of the current subscription, or for credit balances for certifications not consumed.

• External audit
IRCC will have external auditors appointed among reputable members and experts from the photographic community.
The main task of the IRCC auditors will consist of the evaluation and monitoring of all internal and external procedures and methodology to guarantee the provision of guarantees and credibility to users and third parties. In particular:
- Verify the standards and validation methodology performed by IRCC on internal processes and procedures for checking and authenticating images.
- Contribute with the IRCC team to the dissemination and implementation of recommended image processing standards, seeking the highest possible consensus among all members of the photographic community.
The activities carried out by the external audit will be timely reported and notified publicly.
• Storage Policy
IRCC guarantees a stable and effective storage service to all users, through dedicated Linux servers, equipped with SSL security protocols and firewalls that guarantee the safeguarding and protection of data and files (see “Security Policy”).
The storage limits established here may be modified occasionally or due to force majeure, and registered users are notified in a timely manner.
IRCC will keep active user accounts that have more than three IRCC certifications issued on its servers, for a period of 4 years, counted from the expiration date of the last annual subscription contracted. Likewise, IRCC will keep for a period of 4 years from the date of granting each certification, a copy of each certified file that you can download at any time from your registered user account.
• Termination of services
IRCC may suspend any of the services associated with a user account, without prior notice or liability, for any reason, in case of breach of the stipulated terms and conditions.
The cancellation of temporary subscription services does not imply the cancellation of your registered user account, remaining active. The associated contents will remain valid, in accordance with the provisions of the storage policy. It is the responsibility of the registered user to maintain and / or eliminate the visual content of their account after the cancellation of subscription services.
You can stop using your registered user account or close it at any time. In the event of wishing to cancel your registered user account, IRCC will automatically remove all visual content posted to your account.
• On responsibilities and guarantees
The registered user uses the IRCC website and the associated services at their own risk. IRCC expressly disclaims all liability, except those strictly legal, for any loss, injury, claim, liability or damage of any resulting, derivative or in any way related to:
(a) any error or omission produced on the IRCC website, derived from technical inaccuracies or typographical errors.
(b) any third-party site or content linked directly or indirectly to the IRCC website.
(c) the use of IRCC services on any external equipment or software.
(d) the temporary impossibility of using the services of the IRCC website for technical or similar reasons, such as those related to security updates and other updates (including new features or features of the services).
Unless expressly stated otherwise in these Terms and Conditions, IRCC notifications will be sent:
(i) by email to the registered email address associated with the user account
(ii) through the internal messaging system enabled on the IRCC website
IRCC does not include notifications by postal mail or delivery service to the address associated with the user account, unless expressly provided and prior agreement and / or prior notification addressed to the user's email account.

• Applicable legislation
Any dispute that may arise in relation to IRCC and / or the services provided through the IRCC website and / or these Terms and Conditions, will be resolved in accordance with Spanish law and will be submitted, expressly waiving any jurisdiction that may apply. , to the Courts and Tribunals of Madrid, unless the User was considered a consumer for the purposes of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, in which case the Courts and Tribunals of the User's domicile will be competent.
• Other considerations
These terms encompass all its parts and replace any previous version. If one or more of the provisions of this document is considered invalid, illegal or unenforceable in any way, the validity, legality and compliance with the remaining provisions will not be affected or harmed.
Any inconsistency between these terms in Spanish and their translation into any other language, to the fullest extent permitted by applicable law, will be resolved with reference to the Spanish version.
“IRCC Photographic Association” is a non-profit association registered in the National Registry of Associations, in accordance with the current Organic Law 1/2002, of March 22, regulating the Law of Association, whose headquarters are in Avenida de Europa 40, from Pozuelo de Alarcón (Madrid - Spain).
